Competition Terms and Conditions

The competitions are organized by HGH Hotelgesellschaft mbH, in cooperation with various partners (cooperation partners), who generally provide the prizes for the competitions (prize sponsors).

2. Participation

(1) Participation is open only to persons of legal age.

(2) A person participates in the competition by performing the action required for participation within the specified period. This may involve liking and commenting on the post or sending an email with the respective keyword. Each participant is responsible for the accuracy of their details, in particular their email and/or postal address. Entries must be received within the period stated in the competition announcement.

(3) In order to participate and for the execution of the competition, it is essential that all personal details provided are truthful. Otherwise, exclusion may occur pursuant to § 3 (4).

(4) The decision on the winners will be made after the end of the competition period by a jury or via a random generator, under exclusion of the public and with full neutrality of the decision-makers.

3. Exclusion from the Competition

(1) Employees of HGH Hotelgesellschaft mbH and its cooperation partners, as well as their relatives, are excluded from participation.

(2) In case of violation of these terms and conditions, HGH Hotelgesellschaft mbH reserves the right to exclude persons from the competition.

(3) Persons who use unauthorized aids or otherwise gain advantages through manipulation will also be excluded. In such cases, prizes may be withdrawn and reclaimed even retroactively.

(4) Anyone providing untruthful personal details may be excluded from the competition.

4. Execution and Handling

(1) The competition period is defined in the respective competition announcement. Winners will be notified by HGH Hotelgesellschaft mbH via private message or email (if available) after the competition ends. HGH Hotelgesellschaft mbH is entitled to pass on the winner’s data to the cooperation partner (if applicable) to enable delivery of the prize. If the winner does not respond within three weeks of the notification being sent, the claim to the prize is forfeited.

(2) The item, voucher, or room presented as a prize in the competition may not necessarily be identical to the actual prize won. Deviations in model, color, size, etc. may occur.

(3) Unless otherwise agreed in writing with the winner, the prize must be collected by the winner within 14 working days at HGH Hotelgesellschaft mbH, TORTUE HAMBURG, Stadthausbrücke 10, 20355 Hamburg.

(4) In the case of travel or accommodation prizes, processing takes place—unless otherwise communicated—exclusively in direct contact between the winner and HGH Hotelgesellschaft mbH. If no travel date is already specified in the competition, the determination of the travel date is at the sole discretion of HGH Hotelgesellschaft mbH. There is no entitlement to a specific travel date. Upon confirmation of the travel booking, the winner is subject to the hotel’s travel conditions. Travel to and from TORTUE HAMBURG (HGH Hotelgesellschaft mbH) is at the winner’s own expense, unless otherwise stated or expressly agreed. The same applies to any costs incurred during the stay (minibar, telephone, food and beverage consumption, etc.). The value of the trip stated in the announcement may vary seasonally depending on the time of availability and redemption. Compensation for such differences in value is excluded.

(5) Cash payment of the prize or any prize substitute is excluded under all circumstances.

5. Premature Termination

HGH Hotelgesellschaft mbH reserves the right to cancel or terminate the competition at any time without prior notice and without stating reasons. This applies in particular if proper execution cannot be guaranteed for technical (e.g. system viruses, manipulation, hardware/software errors) or legal reasons.

6. Data Protection

HGH Hotelgesellschaft mbH undertakes to comply with all national and European data protection provisions in the context of the competition. Personal data will not be forwarded to third parties or sold. The personal data of the participants will be processed exclusively for the purpose of the competition. By participating, participants expressly consent to the processing of their personal data for the above-mentioned purpose. The right to withdraw consent remains unaffected. After completion of the competition, the personal data of all participants will be routinely deleted.

7. Liability

(1) With the handover of the prize, HGH Hotelgesellschaft mbH is released from all obligations, unless an earlier point in time arises from these terms.

(2) HGH Hotelgesellschaft mbH is not liable for material or legal defects in prizes provided by cooperation partners.

(3) HGH Hotelgesellschaft mbH is not liable for the insolvency of a cooperation partner or for the resulting consequences for the execution and handling of the competition.

(4) HGH Hotelgesellschaft mbH is only liable for damages caused by intent or gross negligence on its part or that of its vicarious agents, or by the violation of essential contractual obligations (cardinal duties). This does not apply to damages resulting from injury to life, body, or health. The limitation of liability applies in particular to damages resulting from transmission errors, delays, interruptions, incorrect content, loss or deletion of data, or system viruses.

(5) In the case of event or travel prizes, HGH Hotelgesellschaft mbH is also not liable for the consequences of justified changes to the event or travel offer. Payment of the travel value is excluded.

(6) Contributions posted by third parties on HGH Hotelgesellschaft mbH’s Facebook/Instagram pages in connection with the competition must not contain insults, false facts, competition, trademark, or copyright infringements. Users are liable for any legal violations. HGH Hotelgesellschaft mbH assumes no liability for such infringements and is entitled to remove such unlawful content.

8. Miscellaneous

(1) The law of the Federal Republic of Germany and the European Union applies exclusively.

(2) Should any provision of these terms and conditions be or become invalid, the validity of the remaining provisions remains unaffected.

(3) These terms and conditions may be amended at any time by HGH Hotelgesellschaft mbH without separate notification.

9. Facebook / Instagram Promotion

(1) This promotion is in no way connected to Facebook/Instagram and is not sponsored, supported, or organized by Facebook/Instagram. The recipient of the information provided is not Facebook/Instagram but HGH Hotelgesellschaft mbH in cooperation with various partners (cooperation partners).

(2) Comments that violate Facebook guidelines, German law, netiquette, and/or copyright will be removed without notice as soon as they become known. The participant will thereby be excluded from the competition.
